TERMS AND CONDITIONS

 

GENERAL CONDITIONS
  • Ownership of all plants is retained by Springfield Nursery Ltd until paid in full.
  • An extra sum of 5% of the value of your purchase will be charged per month for every month that the account is overdue.
  • Plants and freight must be paid in full by either direct credit, cheque or cash before dispatch, unless other arrangements are made between Springfield Nursery Ltd and purchaser.
  • Orders will be despatched within 5 working days of receiving payment.
PRICE
  • All prices, and any offers for supply or price lists, are subject to variation without notice.
  • ALL PRICES QUOTED IN THIS WEBSITE , UNLESS STATED OTHERWISE, DO NOT INCLUDE GST AND REPLACE ALL PREVIOUS PRICES.
DELIVERY OR COLLECTION
  • Orders may be collected from the nursery or freighted to a destination. Springfield Nursery Ltd will arrange freight and charge costs direct to the Customer, unless prior arrangements are made.
  • Cost of packaging is included in the cost of freight.
  • The goods become the responsibility and are at the sole risk of the customer upon leaving the nursery premises. The Customer should insure the goods accordingly.
FORCE MAJEURE
  • The vendor shall not be liable for the delay or failure to perform its obligations arising from any act of God or if the cause of the delay or failure is beyond our control.
CLAIMS
  • The right of reject non-conforming or defective goods shall be limited to rejection notified in writing to the Vendor within 48 hours of receiving the goods, and the goods returned to the vendor with 48 hours of receipt at the Customer's expense. Claims for goods damaged in transit should be made to the last carrier.
ORDER CONFIRMATION
  • Orders are welcomed by telephone, fax,email or in writing.
  • On receipt of your order we will acknowledge availability, or otherwise, of the goods required with an 'Order Confirmation'. Which may require a non refundable deposit of 20%, payable immediately. If after 30 days no deposit is received the order may be cancelled with no notice given. Confirmed orders will  be supplied in full, subject to any shortages caused by conditions beyond our control.
WEBSITE PHOTOS
  • We endeavour to update our photos on a regular basis however due to seasonal changes photos may differ from actual plants received.
